Abstract

Health judicialization is a relevant phenomenon for the organization of the Brazilian Unified Health System, especially in claims involving medicines and technologies not incorporated or not regularly provided. This theoretical-reflective essay aims to analyze Brazilian Supreme Court Themes 6 and 1234 and their normative effects on court-ordered access to medicines, the distribution of responsibilities among federal entities, and the sustainability of public health policies. The study was developed through documentary and bibliographic analysis of precedents, legal rules, institutional documents, and specialized literature. Recent decisions seek to qualify judicial intervention by requiring technical criteria, prior administrative assessment, robust scientific evidence, and stronger inter-federative coordination. Although they represent progress in rationalizing judicialization, their practical effects still depend on monitoring, institutional implementation, and future evaluation regarding access, equity, budgetary impact, and effectiveness of the Brazilian Health System.
